Terms of Services

I. Introduction of Services:

A. The website and services terms of conditions will provide you access to use the services with www.Globalfrag.com. Global Frag Servers, is a registered company under the LLC, these terms will apply to the client whether you are a paid client or any services that may be provided for the client.

B. Our services is the business of providing a monthly leased usage of server space from our server boxes that Global Frag Servers currently owned.

II. AGE RESTRICTION OF CLIENTS:

A. Age Recommendation: Any clients that orders with Global Frag Servers through our online order system, will represent and warrant the client's self that he/she is at least 13 years of age and that the client have the legal capacity to enter into this agreement.

B. Age Restrictions: If the client is not at least 13 years old, the client will terminate our use of our services immediately and may not use or access our services. Any one under the age 18 must have the parents or legal guardian to access the site to pay. You will also agree to bypass any security and/or access features that we may have installed on the order form. Also we do not assume any responsibility or liability for any problems regarding the clients age.

III. ACCESS, LIMITATIONS, RESTRICTIONS

A. Access. Any clients that access Global Frag Server control panels, you may be asked to provide certain information on the order form. It is a major for you to use our services that all you provide will be correct, current, and complete. If we believe that some of your information that you provide us is not correct, or complete, we will then have the right to refuse you to access to our services and to terminate or suspend your access at any time with no refund.

B. Limited License. Subject to these Terms and Conditions and in consideration of using our services, we hereby grant you a limited, nonexclusive, nontransferable personal license to access and use our services. We provide our services for personal, non-commercial use by gamers, viewers, fans, visitors, subscribers and/or potential subscribers. Users of our services are granted a single copy license to use our services and attendant software (on a single computer only). Our services shall be for private non-commercial use only, and all other uses are strictly prohibited. We reserve the right to limit the amount of bandwidth used. You agree to prevent any unauthorized hacking of our services or unauthorized use thereof. Any unauthorized use of our services or any of the Materials contained therein terminates this limited license effective immediately. You represent and warrant that you will not allow anyone under 13 to access our services without the permission of a parent or legal guardian. We reserve the right to terminate this license at any time if you breach or violate any provision of this Agreement, in which case you will be obligated to immediately destroy any information or materials you have downloaded, printed or otherwise copied from our servers. Violators of this limited license may be prosecuted to the fullest extent under the applicable law.

IV. BILLING, PAYMENTS, REFUNDS, FEES

A. Billing. Global Frag Servers will have the right to set-up your services of your choosing only if a full payment is made through our secure online order system. You will also get a generated invoice before 5 days of your invoice is due. It is your responsibilities for your own payments, and you are in charge for any fees may occur during your payments. Our order forms are full secured and we will insure your security once your payment is made.

B. Payments. If there is an overdue balance on your account. Global Frag Servers will have the right to terminate or suspend your services till the full payment is made, we will also notify you once it occurs. Global Frag Servers offers many different types of billing options that may help you to pay for your services. Such as Pay Pal, Credit Card, Google Checkout, and Cash/Money Order.

C. Refunds. Global Frag Servers does NOT provide any refund policy for any of our clients. Unless there was a billing error through our system, which we will provide you a full refund of payment price. You must be aware if using the payment option "PAYPAL" you are responsible for the subscription that is activate once you purchased your services. We will not be held liable for any fees, or misuse of payments through paypal. Once a subscription payment is made we will not refund the amount of payment price.

D. Fees. Global Frag Servers, may charge your account with a fee, that will occur when there is a problem or issues that has occurred to your services. If the problem or issue has occurred because of Global Frag Servers problems, we will not charge your account.

E. Set Up Fees. All set up fees are free for all server rentals, there will be set-up fees for dedicated server services. The set-up fee will be paid for the set-up and the space of the box at the data center.

V. WHAT WE PROVIDE

A. Game Servers. Global Frag Servers, currently provides top quality game servers, with a guarantee high performance game play. Global Frag Servers, also provides the most common games, such as Counter Strike 1.6, Counter Strike: Source, or Day of Defeat. Our server boxes are mainly Quad Processors, with 4 GIG RAM, and 74 GIG HD.

B. Voice Servers. Global Frag Servers, currently provides (temporary) license ventrilo services. It runs with many types of codecs, and we promise the clear voice quality on the servers.

C. Web Hosting. Global Frag Servers, provides hosting on the company server boxes, under the control of WHM, and Cpanel.

D. Dedicated Servers. Global Frag Servers provides dedicated boxes, that ranges from basic speculation to advanced. Each speculation differers in process, ram, and hard drive space.

V. COPYRIGHT INFORMATION:

A. The Materials accessible from our servers, and any other World Wide Web Site owned, operated, licensed, or controlled by us, is our proprietary information and valuable intellectual property. Any copyright infringement will not be tolerated. Our words and software are registered with the U.S. Copyright Office.

B. Our Materials may not be copied, distributed, republished, modified, uploaded, posted, or transmitted in any way without the prior written consent of us, except that you may print out a copy of the Materials solely for your personal use. In doing so, you may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on any of the Materials.

C. Modification or use of the Content except as expressly provided in these Terms and Conditions violates our intellectual property rights.

D. Neither title nor intellectual property rights are transferred to you by the use of our services.

E. All of our Materials, such as text, graphics, photographs, video and audio clips, music, soundtracks, button icons, streaming data, animation, images, downloadable materials, data compilations, and software is the property of Global Frag Servers or its content suppliers and is protected by United States and international copyright laws. The compilation of all of our Materials is the exclusive property of Global Frag Servers or its content suppliers and protected by United States and international copyright laws, as well as other laws and regulations.

IX. UPGRADES

A. All upgrades will not take affect during the current billing cycle, all new upgrades will take place during the start of the new billing cycle. If the client needs an immediate upgrade the client must pay the full price for the upgrade, but the client will not get an extended dates with in their billing cycle.

X. SET UPS
A. All setups are to be made with in 24 hours of the day of purchase. It may change on any specific services such as dedicated servers any many more, you will be notified the setup rate on the description of the order form.

XI. CANCELLATIONS / TERMINATION
A. Our cancellation policy requires and email request to billing@globalfrag.com requesting a cancellation on the server. It is mandatory you provide the name on the account and your server ftp username and password. Cancellations in mIRC must be verified by email to the account holder to be considered canceled.

B. You hereby agree to be personally liable for any and all charges incurred by you until termination of membership for goods or services through your use of the services. In the event that your account is canceled by you, no refund, including any membership fees, will be granted; no online time or other credits will be credited to you or can be converted to cash or other form of reimbursement. This Agreement’s provisions shall survive its termination, unless otherwise stated. Upon our processing of your request to cancel your membership, you will no longer have access to the non-public areas of our services.

VII. FTP Access:
A. We will provide you with ftp access for your gameserver. This absolutely must not be used to store files not related to your gameserver or to file share. The client is responsible for the content. We require you do not exceed 2.5 gigs of space total and reserve the right to eliminate any content at any time.

VIII. Managing Your Gameserver:
A After your server is released to you for game play, it is your responsibility to understand and manage the gameserver. .Your client limit must never be altered unless it is done by an Global Frag technician. If you have rented a password protected server, this password must always remain in place at all times. While we do not monitor public servers, we do expect a high standard from anyone renting a public gameserver. Game server host names and rcon should only be changed by Global Frag staff. Do not add any mods to the server that would use resources without consulting Global Frag staff. Should a customer perform an action that requires an Global Frag technician to repair the gameserver, the customer may be billed for this service. No customer may use any product of GlobalFrag in any illegal manner nor aid any other in illegal activities.

XIV. Connectivity and Ping:
A. We pride ourselves on using only the finest quality servers and well known reputable bandwidth providers. While their reputation is stellar we cannot guarantee their uptime nor anyones ping to a Global Frag server. Variables such as ones ISP, bandwidth, routing, and computer can be the limiting factor. Should any client have ping or related issues with an Global Frag server we request you run a tracert to your server and submit an email to support@globalfrag.com

Our policies may change at any time. It is the responsibility of our clients to monitor this page to keep up to date and current with our TOS agreement. Failure to comply with our TOS may be just cause for Global Frag Servers to terminate our agreement. No other contract shall negate any part of our TOS agreement. We always reserve the right to refuse service to anyone. Once you agree to this TOS, you will agree to any changes with out notice.
